The script writer said in an interview (to more than one anime magazines) 'no, he is dead' (I read this from Newtype Magazine, Wikipedia has a different source regarding this quotation)
I don't see a point in debating his survivability after getting stabbed by a gigantic sword that an ex-elite soldier friend was holding, in a country where everybody hated him, and even the script writer rejecting his survival.
Unless, we were to presume he has out rightly lied or there is a severe plot twist introduced which potentially brings Lelouch back in any series following R2.
