In what way are they identical are they the exact same font size and color?
It just doesn't make sense to me someone please explain

ODEX uses the same subs as the fansub-group does. Normally when you translate/sub an anime, the translations will at least be a little different (just try to download the same episode from two different groups and see the difference), but it seems that ODEX's subs are identical to a.f.k.'s subs, which means that they didn't even translate the anime themselves, but took a.f.k.'s work and put it on dvd... = profit :x
It is true that a.f.k.'s subs aren't copyrighted, so they prolly wont stand a chance in court, but ODEX using the subs that a.f.k. made is just weird (ethically wrong), since they plan on earning money on it

I got it now but couldn't this back fire seeing that a.f.k translated for distribution over the net which is illegal were as ODEX has a license to sell it

Odex is just a bunch of hypocrites to me really...How could they sue somebody for copyrights and then take the subber's work for their own profit?

well, ODEX already got their bad reputation when they started suing anime-fans for BTing anime, but as it is now, the animefans can't do anything about it, since ODEX stands on the right side on the law. So back-fire or not... if the singaporian people wants to continue their anime-journey, then they'll have to pay (a lot) for it
