Well, actually, an anime doesn't have to be aired atm to be licensed. Some series are not and probably never will be licensed, others get licensed at the stage of planning. There is no rule. Anime has to be licensed in other areas of the world by companies in order to be legally released. From what I know, it's pretty expensive and the key is - how to get those money back ;] That's why some companies send legal threats to the funsubbing groups and/or sites hosting series, they have obtained.

At the same time, you can divide those companies in two groups: very persistant and bitchy and less persistant and bitchy. This is the main difference between Bleach [licensed by Viz Media and Mushishi [licensed by FUNimation Entertainment].
